Bunun sonucunda basit yarg\u0131lama usul\u00fc uyar\u0131nca ve <em>r\u00e9vision au fond<\/em> yasa\u011f\u0131 g\u00f6zetilerek y\u00fcr\u00fct\u00fclmesi gereken tenfiz yarg\u0131lamalar\u0131 senelerce s\u00fcr\u00fcncemede kalmaktad\u0131r. Bu nedenle, tenfizin reddi sebeplerinin T\u00fcrk mahkemelerince nas\u0131l yorumlanmas\u0131 gerekti\u011fi T\u00fcrk tahkim camias\u0131nda her daim g\u00fcndemde olmu\u015ftur. Tahkim anla\u015fmas\u0131 tahkimin olmazsa olmaz ko\u015fulu ve gerek tahkim yarg\u0131lamas\u0131n\u0131n gerekse hakemlerin yetkilerinin dayana\u011f\u0131d\u0131r. Bu nedenle Milletleraras\u0131 \u00d6zel Hukuk ve Usul Hukuku Hakk\u0131nda Kanun&#8217;da ve New York Konvansiyonu&#8217;nda yabanc\u0131 hakem kararlar\u0131n\u0131n tan\u0131nmas\u0131 ve tenfizi \u00f6ncelikle taraflar aras\u0131nda ge\u00e7erli bir tahkim anla\u015fmas\u0131n\u0131n bulunmas\u0131 \u015fart\u0131na ba\u011flanm\u0131\u015ft\u0131r.
